Literature As A Revolutionary Tool For American

In tandem with literacy, literature has become one of the leading vehicles for social criticism in American history. It amplifies the author's voice, reverberating it throughout the nation, molding the history of America by changing the opinions of the people on certain issues. It can induce cries of hope and merriment, like John Winthrop's sermon A Model of Christian Charity, which speaks about the optimistic prospect of America as the â€Å"City upon a Hill† (Winthrop, 84). But it can also elicit the noticeable cries viciously pointing out the ignored flaws embedded in this â€Å"more perfect union† (U.S. Const. Preamble)†the existence of slavery, racism, ethnocentrism and the absence of gender equality. While reading this textbook, it is important to keep in mind the question of intention†why a certain piece of literature was written and why during that particular time period and not another. In any case, major movements in American literature leading up to the 19th Century are not arbitrary or random; they are all interrelated by a cause and effect, wherein one movement inspires the critical response of another.The arrival of the Puritans in the sixteenth century brought religious literature into the New World, more specifically ermons such as John Winthrop's A Model of Christian Charity, which grounded the principles required for this infant colony to become the â€Å"City Upon A Hill† (Winthrop, 84). Winthrop's sermon was an implicated work of criticism towards the European structure of society, where social class and bloodline would inherently determine a person's fate in life.Winthrop modeled prospective America according to everything the Old World was not†it would be a country where the â€Å"riche and mighty should not eate up the poore, nor the poore,† (81) where the people â€Å"must love one another with a pure hearte fervently†¦ eare one another burthens†¦ [and] not looke only on [their] ow ne things, but also on the things of [their] brethren† (83). This model appealed to the serfs and peasants of Europe because it promoted equality, a concept not unfamiliar but unattainable to the people belonging to the Old World.Although inequality established by the Old World caste system would later be abolished in the New World, gender inequality still remained to be a prevalent form of inequality amongst the people†notice that Winthrop calls out for equality among the â€Å"brethren† (83) and not â€Å"sistren,† which is the female equivalent of it. Over two centuries later, Nathaniel Hawthorne's The Scarlet Letter would be published in 1850, criticizing the gender inequality within the glorified Puritan â€Å"Model of Christian Charity. Hawthorne points out this flaw by having Hester Prynne, the woman, repent for her sins by public shame and ostracization whereas Dimmesdale, the man, can successfully conceal his sins, albeit it at a great cost in the end. This disparity between the experiences of the opposite sex point out the imperfections within Puritan society as well as society in the 19th century. On the topic of inequality, ccompanied by women were black slaves who received the shortest end of the stick of equality.Following the American Independence in 1774, early 19th century American literature mainly comprised of political documents such as The Declaration ot Independence ot 1776, which was written witn the intention to â€Å"petition tor redress† (US, 1776), which in this case would be independence from the British Crown. The document itself is a social critique on the monarchial system of the British Empire. By listing the â€Å"history of repeated injuries and usurpation† (US, 1776)) inflicted upon the American Colonies, the drafters of The Declaration ofIndependence are explicitly condemning the tyrannical Imperial System that dominated Europe and the Kingdom of Great Britain throughout history. Almo st a century later, the emergence of abolitionist sponsored slave narratives in the 19th century allowed for the direct critique of America's hypocritical claim that the British Crown†the â€Å"Tyrant†Ã¢â‚¬ was unfit to be the ruler of the â€Å"free people† which†later emphasized†excluded the black community.While the fourth of July is often associated with the Joyful celebration of independence, in the perspective of prominent African-American abolitionist Fredrick Douglass, the fourth of July is eferred to as the particular day â€Å"that reveals to [the Negro]†¦ the gross injustice and cruelty to which he is the constant victim [of]† (Douglass, The Fourth of July). The â€Å"Fourth of July is yours [the white citizens], not mine [the blacks]† Douglass said in his 1852 speech â€Å"The Meaning of July Fourth to the Negro. His statement summarizes the fact that the basic rights the whites were born with were not considered as ri ghts or even privileges for the blacks†free or enslaved. Fast-forward to post civil war in 1983; Mark Twain publishes Pudd'nhead Wilson, a tragic comedy criticizing the lack of ights given to slaves. In the conclusion, the creditors of the Driscoll estate claim fake Tom as their â€Å"lawful property' (Twain, 122). This reference to â€Å"property' can be viewed as criticism towards the Supreme Court Case Dred Scott v.Stanford in 1857, where Judge Taney ruled Scott, the slave, as property and therefore cannot be freed, despite setting foot on a free state, because it would be depriving a person of property without due process or Just compensation which violates the 5th Amendment. The comic tragedy of Pudd'nhead Wilson, then, serves as a critical pprobrium directed upon the inequitable ways in which the slaves were treated. The philosophical movement known as transcendentalism began its short, but impactful lifespan during the 1820s and 1830s.Ralph Waldo Emerson and Henry Dav id Thoreau are among the renowned icons of the transcendentalist movement. The transcendentalist movement began as criticism towards society and its institutions†particularly organized religion and political parties. Influenced by Romanticism, the transcendentalists respected the individual spirit and the natural world, believing that divinity was present in nature and each person. In his essay Self-Reliance, Emerson compares an institution to the â€Å"lengthened shadow of one man† (Emerson, 26).Self-Reliance circles itself around the idea of Individualism where â€Å"imitation is suicide† (20), so this comparison suggests that organizations teach principles based on the ideas of a single person, forcing everyone else to conform to the ideas of a man other than themselves†a concept condemned by transcendentalists. Transcendentalism also included the core belief that all men were inherently good†a belief that would later breed a completely different g eneration of writers. Herman Melville was among the writers who advocated ealism, the antithesis of all things romantic or transcendental.His novella Bartleby tells the story of a scrivener named Bartleby. Like Thoreau, Bartleby is a passive resistor. However, while Thoreau argues that his act ot passive resistance trees him, Bartlebys passivity provokes the narrator to confront him, and ultimately, his refusal to accept authority results in his self-inflicted death. Furthermore, although Thoreau considers solitude as his most â€Å"companionable† (Thoreau, 88) companion, Bartlebys loneness was the cause for his boss' comment on his â€Å"incurably forlorn† (Melville, 9) ppearance.The key difference between transcendentalism and realism isn't very far fetched†one is optimistic while the other is realistically grim†while Thoreau's passive resistance liberates him and allows him to fully express himself, Bartleby's passive resistance only affirms the authorit y and control that society has over him. Although the motives for social criticism may vary over the decades, the overall purpose of literature is to act as a vessel for social criticism in order to spark movements†for better or worse† in an otherwise monotonous society.

My High School Years Essay

We all have nice memories of when we attended high school. Memories that will never be forgotten. For most of us it has been a while since high school and it is all a blur. We all remember a lot of things, especially things that the school did and we didn’t approve of. Something that would annoy us, but we wouldn’t be able to do anything about it. The majority of us, I’m sure, don’t like the way the school handled the schedule, the food we had for lunch, or the teachers we had to listen to. One of the things that they need to change in high school is the way they handle the lunch periods. School is already hard on us because of all the homework we get and I don’t think is fair that they won’t allow us to pick our lunch period. We are all accustomed to eating at a certain time. The school would either give us lunch too early or too late. If they gave us lunch too early, we wouldn’t be hungry. In my case I would have breakfast during my study hall which was 3rd period, then I would have lunch which was 4rd period. I would have to force myself to eat or else I would be hungry the rest of the day. If we had lunch too late, we would not be able to concentrate in class because while we were working silently on our work we could hear our stomach growling, students that were sitting around us would just laugh. I remember that when that would happen to me I would start turning the pages of my book real fast so that the students around me couldn’t hear me. When I was in high school most of the students were mean and unfriendly. It was really hard to make friends, at least for me it was, and to be placed in a lunch period where you didn’t know anyone wasn’t easy. Our high school had a big cafeteria that could be divided into three smaller rooms, but they would never open up the walls. The reason for this was that there had been a huge fight once and they didn’t want any more confrontations. Each room had a name, they were named Commons A, Commons B, and Commons C. We weren’t able to pick the common in which we wanted to be in. The school, to make our life more miserable, would also give us assigned seats. One thing that I can’t complain about and that my classmates are probably going to look at me right now for saying this is the food. I went to Belvidere High School and I loved the food! I would look forward to lunchtime every day just because of the food. Till this day I have not found alfredo sauce that is as good as the one that they just to give us in high school. One thing that I would hate in high school was how they would run the schedules. They would give us too much time for one thing and not enough for another. We would go into a classroom for 15 minutes and do nothing. This class period was called home room. The teacher was supposed to inform us of changes that would be going on around the school, but they never would. We would sit there for 15 minutes of our life and basically do nothing. The teacher herself didn’t know what was going on. They also need to take away study hall, people didn’t do their homework during study hall. They would just sit there and talk, they wouldn’t even bring their books to study hall. Instead of getting study hall we should get more gym time. I mean, 45 minutes isn’t enough to actually exercise. By the time that we are done getting dressed we only have about 35 minutes left. Then the teachers instead of hurrying up the students, they’re over there having conversations with the other gym teachers . Then they take forever to take attendance. By then time they’re done explaining what were actually doing that day, we have like 25 minutes left of gym, not including the 5 minutes they give us at the end of the class period to get changed. 20 minutes is not enough time to run a gym class. We can’t exercise, sweat and take a shower in that little time and then the media complains that the students are obese. The method that some teachers have of teaching is absolutely awful. My Spanish teacher for native speakers was really nice and got along with everyone. All the students would talk so well about her, they would always say positive things about her. Probably because they never did anything while they were in her class. The only thing was that she was horrible at teaching. Well, it wasn’t that she was horrible at it, it was just that she wouldn’t teach anything. I remember she got sick and was out for three months. During that time we literally did not do anything. I remember that the substitute would just look at us and he would ask us what would we usually do, we would look at him, smile and answer â€Å"nothing†. Don’t ask why, but this was the second year that I had taken Spanish class with her, so when she came back she told us that most of us had been with her for two years so she would give us a grade based on what we had gotten the year before. I took that class to improve my writing in Spanish, to learn the proper grammar, but I did not achieve any of that. The English teachers weren’t as bad as the Spanish teacher, but we still didn’t accomplish much. The only time that I remember writing an essay in high school was junior year. Maybe it had to do with the school that I was in. My junior year of high school I went to Belvidere High School instead of Elgin High School. In Belvidere High the teachers were a little more strict, at least that’s what I thought. Until I found out that the only teacher that had ever assigned me to do an essay had been with one of the students. I was completely shocked because she had always been very professional about her job. Even though there’s a lot of negatives things with the high school that I went to, I still enjoyed every minute of it. I got to meet new people and experience new things. Sure my high school wasn’t the best, but I am still thankful that I received a basic education. The only thing that I do regret is not going to prom. I told myself that if no one asked me to prom that I wouldn’t go. Nobody ended up asking me so I didn’t go. I lost the chance to experience something that you only get to experience once in your life. So enjoy your high school while you can because once you are out, there is no turning back.

Kudler Fine Foods Computer Information System Essay

Kudler Fine Foods (KFF) is a California-based provider of a variety of high end foods, both local and from around the world, founded by Kathy Kudler in 1998. Since the opening of the first location, Kudler has opened two more locations in the San Diego area; Del Mar in 2000 and Encinitas in 2003 (About, 2011). As a growing business, Kudler’s needs are constantly changing, especially in terms of the company’s information technology and information systems. This paper will discuss the needs of the company in regards to business operations and accounting, as well as discuss the strengths and weaknesses of the systems currently in place. Based on the current technological opportunities, suggestions will be made to further improve these systems, and evaluate any threats that may affect these systems. Primary Findings Business and Accounting Needs Business Needs As a retail company, Kudler Fine Foods needs to run as smoothly and efficiently as possible. Kathy Kudler budgeted over $50,000 for Smith Systems to select and install the existing finance and accounting system, called Retail Enterprise Management System (REMS). REMS provides an Point-of-Sale module, or POS module, to automate all retails sales made, in detail. This system automatically reports this data to the accounting modules, as well as manages all credit/debit card transactions made in the stores. This helps to eliminate data entry errors by limiting the amount of data requiring manual input by employees (Accounting System Overview, 2011). Accounting Needs REMS also addresses the accounting needs of KFF, by providing applications for the general ledger, accounts payable, bank reconciliation, asset management and accounting modules. Each of these modules is interconnected with the POS, which allows for direct transfer of data between modules (Accounting System Overview, 2011). General Ledger Module. The General Ledger module includes the chart of accounts, and transaction details transferred y the POS system. This data is used to create the company’s budget and financial reporting. Due to the electronic transfer of data from the POS to the general ledger, this module requires minimal manual data entry (Accounting System Overview, 2011). Accounts Payable Module. The AP module allows for the check disbursement portion of the business to be done electronically. This module holds vendor data, tax and freight data, and accepts data from other modules that directly affect purchasing (Accounting System Overview, 2011). Bank Reconciliation Module. Data from the accounts payable, accounts receivable and purchase order modules are compiled automatically by the bank reconciliation module. This data is used in cash flow analysis for financial reporting (Accounting System Overview, 2011). Asset Management and Accounting: There was no module created for this portion of the business. Kudler needs to develop an efficient and economical way to track inventory and other assets, other than relying on the leasing company and spreadsheets (Accounting System Overview, 2011). Strengths and Weaknesses in the Current System Strengths The strength in the existing information system is that the modules that are installed reduce the manual data entry, thus eliminating unnecessary errors to the information, by allowing the modules to share information provided by the point-of sale machines. The POS system itself is a major benefit to the IT system as a whole, due to the number of transactions it is able to detail, catalog and parse to the interconnected modules. Secondly, the network set up at each location supports 3-4 POS terminals, an inventory terminal and a server terminal. Each individual network, for each store is providing enough storage power for the needs of each location (Information Technology, 2011). Weaknesses As previously discussed, the network setup has benefits on an individual store basis. However, the system as a whole is not sufficient in running a cohesive, multi location business. Kudler’s inventory systems are completely separate from one another, which could cause a serious issue in asset management within the company. A second weakness is the lack of policy regarding security within the system. This could lead to vulnerability to an internet attack for customer personal information and identity theft. Also, without back up procedures, there is no way for Kudler to prevent data loss, should the network(s) fail. Recommendations Based on the information above, the recommendation for Kudler and KFF would be to first, establish a set of security policies and back up procedures, in order to prevent hacking and data loss, respectively. In order to do so, Kudler would best benefit by reestablishing a working relationship with Smith Systems. Smith would then set up and maintain an offsite server that will service all three KFF locations, and allow the company to consolidate the three separate inventory systems. The offsite server would then serve as a repository for all accounting, inventory and human resources related items. Doing so will cut down the potential staffing and duplication in the inventory system. Additionally this would reduce the number of servers required, and thus reduce the potential of IT related hardware issues. Conclusion To conclude, Kudler Fine Foods uses and information system established by Smith Systems that sufficiently handles point-of-service retail sales receipts, and disburses the information to the appropriate accounting software modules. The modules receive the financial data from the sales to create financial reports, budgeting reports, and analyze accounts receivable and accounts payable. The system also maintains ordering and purchase order data, however, it does not maintain a single inventory module, which could track the sales of these items after the goods are received in the individual stores. In order for this to occur, Kudler needs to establish a solid set of security measures and procedures in the case of data loss. To address this, Smith Systems can be contracted to maintain an offsite server with security maintenance. This will help to prevent internet attacks by hackers searching for customer identification and credit card information. Once these changes are in effect KFF should see an increase in efficiency in the current systems in use.

The first HBCU was established in 1837, twenty six years before the end of slavery (Coleman), in Pennsylvania and named Cheney University. The school catered to African Americans who have just earned their freedom from their slavery, who wanted to earn an education which they believed would grant them better lives. It was birthed by a Quaker who was also known to be a philanthropist, who yearned to educate and train free Blacks to become teachers (Coleman). For years, HBCUs stood for the educational rights of African American citizens and provided them with quality education that helped them actively participate in their communities. Among them are Alabama Agricultural and Mechanical University organized in 1875 through the efforts of a former slave, William Hooper Council; Bowie State University which boasts of its dedication to the advancement of knowledge through teaching, research and service; and Lincoln University, known as the oldest historically black university founded in 1854 (thurgoodmarshallfund.net). The Historically Black Colleges and Universities boast of quality education that made way for a lot of African Americans and other cultures alike to succeed in the educational arena not only for undergraduates but also for graduate studies. Reflection: When I saw her crying I immediately went over and asked her what was wrong because I never like it when people are crying I like it when people are happy. Full-Scale Fatigue Testing using the Resonance Method Welding: Welding is a process that is employed to join two distinct pieces of the same metal or remove any unwanted material from metals. In other words, the welding can be broadly discussed as the forging of two heated metals by employing electrode which acts as a slag and prevents the atmospheric contamination. The art of welding began when man started forging tools from metals. The first form of welding that was available to mankind was metal forging by pounding a metal until they are fused together. [1] Types of Welding: We live in a world where we can fuse a metal and separate a single metal into many components. There are many available methods of welding to achieve this objective. They have all been evolved from the idea of forging and have a high influence in the human survival. Some of the different types of welding that are been used are: Â   Â   Oxy-Acetylene gas welding Shielded metal arc welding (SMAW) Gas tungsten arc welding (GTAW) Electroslag welding (ESW) Gas metal arc welding (GMAW) Submerged arc welding (SAW) magnetic pulse welding (MPW) Electric resistance welding (ERW) Flux-cored arc welding (FCAW) laser beam welding and electron beam welding [2] Weld Geometry: Welding two metals depends on a numerous factor such as type of joints, type of welds, groove face, root face, root edge, bevel angle, depth of bevel, groove angle, groove face, groove radius, and root opening. Based on all these factors there are nine categories of welds. They have an impact on the total life of the component. A flaw that can cause disruption in the performance of a metal gives us an idea on the integrity of the metal. In case of welding the defect can occur in the area that has been welded. Based on the study, it is identified that most of the failure in the welds occur due to wrong technique, process conditions, bad weld groves, incorrect consumables and operator error. The common types of failures that occurs in welding are due to hydrogen embrittlement and residual stresses. So, the type of welding failure that can affect the life of the metal component are: Arc strike cracking Undercut Cold cracking Hot cracking Crater crack Root and toe cracks Hat crack Underbead crack Lamellar tearing Longitudinal crack Gas inclusion Reheat cracking Distortion Inclusions Transverse crack Lack of fusion and incomplete penetration [4] Fatigue: Fatigue may be characterized as the weakening of metal caused by the frequent application of cyclic loading and unloading. It causes progressive structural damage to the material. The fatigue strength is defined as the maximum strength a material can exhibit without breaking is an important dimension that is employed to study the life cycle of the metal or the welded structure. The BS 7608 or DNV-RP-C203 gives us an idea about the fatigue strength to the applied load for different weld geometry. Principle of Fatigue Testing: Resonance Method Testing is employed for the analysis of fatigue in welds. The process involves the excitation of the welded metal to be tested to its first mode of vibration by applying rotational radial force at one end. The rotational force causes a bending moment in its longitudinal axis of the welded metal with two nodal points without any deflection. The welded metal is supported at these points. The resonant frequency depends on the mass and stiffness of the material. Usually the tests are conducted below the resonant frequency to control the stress and thereby regulating the strain and deflection. Industrial Application: Resonant Testing Machines is the commonly employed fatigue testing machine when compared to its counterpart Servo-hydraulic testing machines due to its advantages such as better efficiency, high frequency, low maintenance and cost. They are used for the fatigue analysis of aerospace and automotive fasteners, engine components, turbine blades, chains etc. Aerospace Industry: Resonant test is employed in aerospace industry to study the fatigue strength of the composite materials such as Glass Fiber Reinforced Polymer (GFRP). They are employed to study the fatigue strength of aerospace fasteners such as bolts, screw, studs and rivets. An aircraft uses an utmost 3 million fasteners with bolts taking 25% and the rivets taking the rest. So, fatigue test is done to analyze the reliability of the fasteners to the repeated pressure and temperature cycles, variations in dynamic loads, and high vibration levels. Automotive Industry: Resonant tests are being implemented in structural dynamics lab in order to study the fatigue strength of high stiffness components such as the automotive components such as connecting rods, crankshafts, bolts, brackets, gear teeth, knuckle etc. The test duration is controlled by the stiffness of the material and the frequency can go high as up to 100 Hz. Features of a CIF contract The central feature of a CIF contract is that it is a shipment contract. This fact explains virtually every contractual and legal feature of the contract. Even if the CIF contract was the only standard form of shipping contract, which it is not, it would be very difficult to agree with the above statement; the contractual and legal features of this contract are explained by its title rather than its industry application. The acronym C.I.F. stands for cost, insurance, freight and represents those features which are included in the cost-price of the goods to be purchased[1]. ‘Cost’ simply pertains to the actual cost of the goods being purchased, ‘insurance’ quite literally means that the goods will be protected by an insurance policy during their transit and ‘freight’ refers to the cost of shipping the goods by carrier to the final delivery point. The best way to explain and understand the contractual and legal features of the C.I.F. contract is by way of an example. Consider the following: A. Ltd. [based in Ireland] offers to sell to B. Ltd. [based in England] 10,000 Kilograms of King Edward potatoes [A-grade quality] for  £2000 C.I.F. Liverpool. B Ltd. accepts the offer in writing. A legally binding contract has thus been formed. Let us now examine every stage of the execution of this contract, with particular focus of the respective contractual duties of A. Ltd., the seller, and B. Ltd. the buyer. Clearly, the first duty of A. Ltd is to appropriate 10,000 Kilos of A-grade quality King Edward potatoes. It may be that A. Ltd. already has this quantity of potatoes stocked in one of its warehouses in Ireland. Alternatively, A. Ltd. may know of a carrier which is on its way to Liverpool carrying this quantity of potatoes on board, in which case, A. Ltd. might choose to purchase them from their current owner while they are afloat. Alternatively, A. Ltd. may have already dispatched a shipment of potatoes to Liverpool, in which case, it may simply choose to assign the appropriate quantity of potatoes to meet B. Ltd.’s order. In light of the fact that the contract stipulates both the quantity, namely 10,000 kilos, and the quality, namely A-grade quality King Edward variety potatoes, the seller is under a duty to ensure not only that the goods dispatched/purchased/assigned meet this description, but also that they will continue to meet this description on delivery; in the case of Mash Murrell Ltd. v. Joseph I. Emanuel Ltd. [1961][2] it was held that there is an implied term in all C.I.F. shipping contracts that, at the ‘time of shipment’, the goods are of a sufficient quality to survive normal transit. A. Ltd., having appropriated the 10,000 kilos of potatoes, must then arrange for these potatoes to be shipped to Liverpool, the destination stipulated in the contract, and it is A. Ltd.’s duty to pay for the cost of this shipment, i.e. the freight. In return for this shipment fee, the carrier must provide to A. Ltd. a valid[3] Bill of Lading. A Bill of Lading is a document which contains the terms of the contract of carriage, as well as a statement that the goods have actually been shipped[4]. Essentially this document serves at the title of ownership, i.e. whoever possesses this document is entitled to take possession of the goods. In the case of Hansson v. Hamel Horley [1922] A.C. 36, the House of Lords held that once the seller has transferred the Bill of Lading to the buyer, conferred on they buyer are two distinct rights; â€Å"(a) a right to receive the goods[5], and (b) a right against the shipowner, who carries the goods, should the goods be damaged or not delivered. †¦ Regarding the former right, it therefore follows that this document be freely transferable [Soproma SpA v Marine Animal By-Products Corp. [1966] 1 Lloyds Rep. 367]. Regarding the latter right, it therefore follows that the Bill of Lading, when pr ocured by the seller, in our example A. Ltd., must be an accurate reflection of the state of affairs at the time of shipment. This principle was confirmed by the Court of Appeal in the case of The Galatia [1980] 1 W.L.R. 495. In this case it was held that the Bill of Lading must include a factually accurate statement as to the quality and quantity of goods which have been shipped. Where any quality or quantity is listed as ‘unknown’ on the Bill of Lading, the Court has tended to infer a presumption that the presumed state of the goods is â€Å"not wildly at odds† with the quantity or quality in fact loaded[6]; be â€Å"not wildly at odds† with the quantity in fact loaded. Returning to our example: A. Ltd. has thus far appropriated the cargo of potatoes, has made/procured a contract of carriage, at his own cost, and has received a valid Bill of Lading from the carrier, as receipt of shipment. A. Ltd. must now, as part of his final contractual duties, secure an insurance policy, again at his own cost, to protect the potatoes from all ‘usual risks[7]’ which might occur during their transit from the point of shipment to delivery at the port of Liverpool[8]. It is also important that the type of insurance policy secured is fully transferable, i.e. assignable by endorsement under S. 50(3) of the Marine Insurance Act 1906[9]; after all, after the goods have been delivered to B. Ltd., this company may wish to transfer the goods to a third party, who may then need to rely on the insurance cover, should it later transpire that the potatoes were damaged during their voyage at sea. These documents having been obtained, A. Ltd.’s final contractual duty is to ensure that these documents are sent and delivered to B. Ltd. I good time, so that they will have them in their possession at the moment the carrier delivers the potatoes to Liverpool[10]. Having discussed the contractual duties of the seller under a C.I.F. contract, let us now turn to examine the contractual duties of the buyer, B. Ltd: The first thing to note is that the buyer does not buy the goods themselves, but rather buys the documents pertaining to the goods, namely the Bills of Lading and the Insurance policy. Thus the buyer, B. Ltd., is under a duty to accept these documents from A Ltd. and pay for them. This duty is not absolute; the buyer has a right to reject these documents if they indicate that the cargo has been shipped late (i.e. later than the shipping date stipulated by the contract). This was confirmed by the High Court in the case of Kwei Tek Chao v. British Traders Shippers Ltd. [1954] 2 QB 459. Likewise, the buyer has a right to reject improperly tendered documents: In the case of Alkali Export Corp. v. Fl. Bourgeois [1921] 3 K.B. 443, the High Court held that the buyer was within his right to reject the documents for they did not contain a valid insurance policy, but rather an insurance certificate. Interestingly, under this conception of the C.I.F. contract, the buyer has a duty to pay against the documents even if he has not yet had a chance to inspect the goods[11]. This principle was confirmed in the case of Biddell Bros v E Clemens Horst Co. [1911] 1 K.B. 214, and was reiterated in the case of Manbre Saccharine v. Corn Products [1919] 1 K.B. 198, in which it was held that the buyer must pay against the documents even where the goods are damaged upon arrival. Prima facie, this might seem somewhat unfair; after all, why should a buyer pay for goods which have arrived in a damaged condition.
